Research theme Two: Property, Publicity, Priority

Property law is not currently included in the proposed Common European Sales Law.  Harmonisation discussions ask whether property laws should be incorporated into the Sales law at a later stage or into a separate legal instrument. To address these questions, this research theme examines two topics.

The justification for property entitlements

How is property acquired?  To what extent do laws protect title holders and how justified are these existing entitlements and protections? What priority is given to rights and responsibilities regarding property?

Apparent Entitlement

Research examines publicity systems, clearing and settlement, publicity and priority and good faith purchase protections. 

Research methods on this theme incorporate doctrinal, comparative and theoretical perspectives.
