Study for the European Commission to support the fitness check of EU consumer law

Prof. Marco Loos prepares a country report on the Netherlands for the Study for the European Commission to support the fitness check of EU consumer law which is expected to be finalized in September 2016.

Country report

As a member of a consortium headed by Civic Consulting (Berlin), Marco Loos will write the Dutch country report analysing national consumer and marketing law, focusing on the national transposition of the following five Directives, as well of relevant national provisions going beyond the minimum harmonisation requirements of the following directives: Unfair Contract Terms Directive, Unfair Commercial Practices Directive, Price Indication Directive, Misleading and Comparative Advertising Directive, Injunctions Directive. Not covered are the Sales and Guarantee Directive and the Consumer Rights Directive (which will be subject to a separate evaluations). However, the study will examine specific aspects of interplay between the listed directives and other horizontal and sectoral consumer law instruments which are based on EU legislation.

Outcome

The outcome of the research is expected to be used by the European Commission during the negotiations on the pending proposals for directives on digital content and distance sales contracts.
